In Turkey, the process of receiving alimony for a child (referred to as child support) from a spouse is governed by the Turkish Civil Code. Here’s how you can proceed:
1. Determine Eligibility
If you have custody of the child, you are entitled to request child support (iştirak nafakası) from your spouse who does not have custody.
The amount of child support is determined based on the financial capacity of the paying parent and the needs of the child.
2. File a Legal Petition
You must file a petition for child support at the Family Court (Aile Mahkemesi) in the district where you or your spouse resides.
Include details about:
Your income and expenses.
The child's expenses (education, healthcare, daily needs).
The financial status of your spouse.
3. Provide Evidence
Prepare documentation such as:
Proof of your income and financial situation.
Documents showing the child's needs (school fees, medical bills, etc.).
Any evidence of your spouse's financial capacity, such as salary details, property ownership, or business income.
4. Court Hearing
Both parties will present their cases in front of the judge.
The judge will evaluate the evidence and decide the amount of child support, ensuring it meets the child's needs without excessively burdening the paying parent.
5. Enforcement of the Decision
If the court orders child support and your spouse fails to pay, you can seek enforcement through the bailiff’s office (İcra Müdürlüğü) by filing an execution request.
6. Modification or Termination
If circumstances change (e.g., a significant change in the financial situation of either party), you can apply to the court for an adjustment in the child support amount.
Important Notes:
It’s advisable to consult a lawyer experienced in family law for guidance and to ensure proper preparation of your case.
Legal aid may be available if you cannot afford a lawyer.
